Kandi Burruss plans to countersue Johnnie Winston III for defamation

The JasmineBrand dug up Kandi Burruss' first court paper response to former employee Johnnie Winston III's Fulton County Superior Court civil lawsuit against her over wage issues. And it's not pretty.

He claimed she made him work without paying proper overtime and was denied the pay when asked. She said he was an independent contractor. On "The Real Housewives," he also said he believes Kandi and her husband Todd Tucker stole his ideas for a play "A Mother's Love" and a restaurant OLG restaurant. The attorney on the show representing Winston Oscar Prioleau agreed to take on only the wage portion of his claims and the lawsuit was filed October 27, 2016.

In her response, Burruss accused him of a breach of a non-disclosure agreement and defamation, aggrandized by what he said on "Real Housewives of Atlanta" during the season finale on Sunday. (You can read some of the paperwork here.  And more here. ) She said he purposely threw these allegations out and approached attorney Phaedra Parks to gain attention.

"As a direct and proximate result of Mr. Winston's false and malicious statements and publications, Defendants have suffered, and are suffering damages,  including, but not limited, to, humiliation, ridicule, hatred, contempt, injury or impairment in their reputation and/or standing in the community and/or embarrassment, which damages will continue to be suffered now and in the future. The injuries are either permanent or continuing in nature."

She said she only learned of his dissatisfaction while taping the show last August, six months after he had let her go.
