A 23-year-old fugitive who was on the Atlanta Police Department's "Most Wanted" list tried to flee before being arrested last week, according to an incident report.

Atiba Daniel had active warrants out of Atlanta, DeKalb County and Fulton County. APD charges from August — which included kidnapping, armed robbery and participation in criminal street gang — alleged that Daniel shot in the leg a man who no longer wanted to be part of the Sex Money Murder gang and attacked him again two days later.

An investigation into Daniel's whereabouts led members of the U.S. Marshal's Southeast Regional Fugitive Task Force to an apartment complex on Hollywood Road in northwest Atlanta on Jan. 23.

The incident report describes a tense scene in which Daniel allegedly tried to flee through a side window and then refused commands to surrender before eventually getting on the ground and crawling towards officers. He was taken into custody with “minimal use of force,” the report says.

Officers asked Daniel about a stolen Dodge Challenger in the parking lot, and Daniel allegedly told police he got it from “an unknown person on the street.” He also had an assault rifle that he bought “off of the street” for $300, the report said.

Daniel is in Fulton County Jail.
