The murder trial of Atlanta attorney Claud “Tex” McIver was delayed Wednesday until March, and McIver may be freed from jail until then.
Fulton County Superior Court Judge Robert McBurney was to issue bond conditions later Wednesday. Those conditions are not yet known, and it remains unclear whether McIver can fulfill them.

The trial was delayed over concerns that both the prosecution and the defense need more time to prepare.
The delay will “ensure that both sides have sufficient time to to review the evidence and prepare for trial,” according to McBurney’s order.
McIver stands charged with intentionally killing his wife, Diane, on the night of Sept. 25, 2016, as they drove along Piedmont Avenue. McIver says the shooting was accidental. He has been in jail since April due to a bond violation. The DA found a gun in the sock drawer of his Buckhead condo.
